Summary of Violations:
The above accounts have not been validated as required by federal statute. No lawful evidence of bona fide debt, assignment, chain of title, or verified contract has been produced upon demand. This constitutes knowing publication and/or collection of fraudulent, inaccurate, incomplete, or otherwise unlawful information.
Enumerated Statutory Violations:
Fair Credit Reporting Act (FCRA) (Public Law 91-508, 84 Stat. 1127 et seq.):
• Reporting, maintaining, or failing to remove any item not fully verified as accurate and complete is willful noncompliance with FCRA and is unlawful.
• Each instance of furnishing or failing to correct unverified or inaccurate information constitutes a separate statutory violation.
Fair Debt Collection Practices Act (FDCPA) (Public Law 95-109, 91 Stat. 874):
• Attempting to collect any debt without providing full validation upon request is a violation.
• Knowingly communicating or reporting unvalidated debt constitutes a deceptive and unlawful practice.
Consumer Protection Act (124 Stat. 1376):
• Prohibits publication, dissemination, or collection of any false, deceptive, or misleading information regarding consumer financial accounts.
Privacy Act (88 Stat. 1896):
• Disclosure, publication, or retention of personal or account information without lawful basis, consent, or verifiable evidence is expressly prohibited.
A. MANDATORY MAXIMUM ACCURACY DEMAND FCRA §607(b), 84 Stat. 1129
The Consumer Reporting Agency (CRA) is under a non-discretionary legal mandate to “follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates.” This requirement is not subject to lesser standards of “substantial” or “approximate” accuracy. The CRA must provide a full and itemized account of:
The exact procedures used to collect, verify, and update all information relating to each disputed item;
The names, roles, and contact information of all individuals and entities involved in verifying or updating the disputed data;
A copy of all documentation, contracts, assignment records, and any evidence relied upon to “verify” the data reported;
Certification, under penalty of perjury, that all records are current, complete, and accurate to the standard of maximum possible accuracy;
Removal of any item for which the above cannot be produced, with written confirmation of removal within 5 business days.
Any failure to comply is an explicit violation of federal law, actionable for statutory damages and subject to regulatory enforcement.
B. 5-BUSINESS-DAY FURNISHER NOTIFICATION CERTIFICATION FCRA §611(a)(2), 84 Stat. 1128
The CRA is required by federal law to, within five (5) business days of receiving a consumer dispute, transmit all relevant information and documentation about the dispute to each furnisher involved. I hereby demand:
Certified proof of the date and time the dispute was received by the CRA;
Certified proof of the date, time, and method each furnisher was notified;
The names and direct contact information of all agents or representatives to whom the notification was delivered;
A complete copy of the notification(s) sent, and a list of every item included in the transmittal;
Confirmation that no account was updated, modified, or removed prior to proper notification and completion of investigation.
Failure to provide all records constitutes a willful violation, reportable to the Federal Trade Commission (FTC), Consumer Financial Protection Bureau (CFPB), and subject to immediate civil action.
C. FURNISHER INVESTIGATION AND RECORDS DISCLOSURE DEMAND FCRA §623(b), 84 Stat. 1129
Upon receipt of a dispute forwarded by the CRA, every furnisher is required to conduct a lawful, thorough, and independent investigation of the disputed information. I demand:
Certified documentation of the date and time the investigation began and concluded;
The names, positions, and qualifications of every individual who participated in the investigation;
An itemized and chronological log of every investigatory step, method, and communication undertaken;
Copies of every document, record, note, or correspondence reviewed, produced, or relied upon during the investigation;
The names and addresses of all Consumer Reporting Agencies, entities, or third parties to whom the outcome was reported;
Written certification that the information remains, after investigation, fully accurate, complete, and lawfully reportable, or else confirmation of immediate deletion/correction;
Confirmation that no data was updated or modified before both CRA notice and completion of all required investigatory steps.
Any omission or delay is a per se violation of federal statute and will be documented as evidence of willful or negligent noncompliance.
D. NOTICE: ILLEGAL PREEMPTIVE OR UNAUTHORIZED DATA UPDATES FCRA §623(b), 84 Stat. 1129; Congressional Record
Any modification, update, deletion, or alteration of credit file data by a CRA or furnisher, prior to proper notice of dispute and lawful completion of the investigatory process, is expressly forbidden. Any “preemptive” or undocumented change—regardless of intent—will be construed as a fraudulent circumvention of required federal procedure. Such conduct:
Invalidates any claimed verification or accuracy for the affected account(s);
Constitutes knowing and willful noncompliance, triggering maximum civil penalties;
Is reportable to the FTC, CFPB, U.S. Department of Justice, and Congressional oversight authorities;
Is fully actionable by the consumer for statutory and punitive damages, as well as emergency injunctive relief in federal court.
The undersigned reserves all rights to pursue every available remedy for any unauthorized update or modification.
E. DOCUMENTED DAMAGES AND FEDERAL PENALTY DEMAND FCRA §§616–617, 84 Stat. 1129; FDCPA §813, 91 Stat. 881; Consumer Protection Act; Privacy Act
As a direct, documented, and continuing result of your agency’s willful and/or negligent violations of the above statutes, I have sustained:
Denial of credit, increases in the cost of credit or insurance, loss of employment opportunities, and reputational harm;
Emotional distress, frustration, and obstruction of access to lawful financial and personal services;
Unlawful disclosure, maintenance, or publication of personal data without verification or consent.
Pursuant to FCRA §§616–617, FDCPA §813, Consumer Protection Act, and Privacy Act, I demand:
Immediate cessation of all collection, publication, and dissemination of disputed/unverified data;
Written confirmation of permanent deletion or correction of all such data;
Full accounting for all damages, statutory penalties, punitive damages, court costs, and attorney’s fees as required by law.
Notice: Failure to comply may result in civil litigation and referral to all appropriate federal enforcement authorities.
ENFORCEMENT SCOPE AND NOTICE OF FEDERAL JURISDICTION:
This report is issued under the direct statutory enforcement authority of the Federal Trade Commission (FTC), Consumer Financial Protection Bureau (CFPB), and all agencies granted jurisdiction under the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Consumer Protection Act, and Privacy Act. No agency, furnisher, or third party may lawfully override, condition, or obstruct the Power of Attorney process, nor may any act of obstruction, retaliation, or delay be imposed upon the consumer’s lawful exercise of these rights. Every act of interference, retaliation, or continued publication of false, unverified, or unvalidated information is a per se violation, subject to immediate investigation and maximum statutory penalty.
Demand for Remedy:
I demand the immediate and unconditional removal of all unverifiable, unvalidated, or otherwise inaccurate accounts; a permanent cessation of collection, reporting, or publication of any such data; and a complete accounting of damages and statutory remedies as permitted by law. Failure to comply will result in immediate pursuit of all available federal remedies.
